If your case is denied before the ALJ, you must appeal the case to the Appeals Council (areview board within the Social Security Administration), which may issue its own decision, send the case back to the ALJ for another hearing, or allow the ALJ’s decision to stand. This is the final level of appeal within the Social Security Administration’s administrative process. If you are denied again at this stage, the next level of appeal is to bring a civil action with the Federal Court and ask a Federal Judge to overturn the decision or order a new hearing in the case.
